Republic Act No. 11112

AN ACT CREATING A BARANGAY TO BE KNOWN AS BARANGAY POBLACION 2 IN THE MUNICIPALITY OF VILLANUEVA, PROVINCE OF MISAMIS ORIENTAL

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1. Creation of Barangay Poblacion 2. - There is hereby created a barangay to be known as Barangay Poblacion 2 in the Municipality of Villanueva, Province of Misamis Oriental.

Section 2. Territorial Boundaries. - The territorial boundaries of Barangay Poblacion 2 shall be identified as follows:

Bounded on the Southwest (SW), along line 1 to 2 by Barangay of Katipunan;

On the West (W), along lines 2 to 5 by Barangay of Poblacion 3;

On the Northwest (NW), along lines 5 to 39 by Barangay of Poblacion 1;

On the Northeast (NE), along lines 39 to 56 by Barangay of Poblacion 1;

Along lines 56 to 59 by Barangay of Imelda;

Along lines 59 to 61 by Barangay of Dayawan;

On the East (E), along line 61 to 62 by Barangay of Dayawan;

On the Southeast (SE), along lines 62 to 73 by Barangay of Dayawan;

On the Southwest (SW), along lines 73 to 84 by Barangay of Dayawan;

Along lines 84 to 1 by Barangay of Katipunan.

Containing an area of 832,454 square meters, more or less.

Section 3. Conduct and Supervision of Plebiscite. - The plebiscite conducted and supervised by the Commission on Elections (COMELEC) pursuant to Provincial Ordinance No. 914-2006 of the Sangguniang Panlalawigan of the Province of Misamis Oriental, which ratified the creation of Barangay Poblacion 2 as proclaimed by the Plebiscite Board of Canvassers on April 22, 2006, shall serve as substantial compliance to the plebiscite requirement under Section 10 of Republic Act No. 7160, as amended, otherwise known as the "Local Government Code of 1991".

Section 4. Barangay Officials. - The incumbent elected barangay officials of Barangay Poblacion 2, Municipality of Villanueva, Province of Misamis Oriental shall continue to hold office until such time that their successors have been duly elected and qualified.1âwphi1

Section 5. Public Infrastructure and Facilities. - All public infrastructure and facilities for public use existing therein at the time of the approval of this Act are hereby transferred without cost or compensation to the new barangay and shall be administered by the same.

Section 6. Internal Revenue Allotment Shares. - Barangay Poblacion 2 shall be entitled to Internal Revenue Allotment (IRA) shares pursuant to Section 285 of Republic Act No. 7160, as amended, otherwise known as the "Local Government Code of 1991".

Section 7. Effectivity. - This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
