Executive Order No. 5, March 5, 2001

AUTHORIZING THE TRANSFER OF THE ADMINISTRATION OF UPLAND PINATUBO RESETTLEMENT COMMUNITIES FROM THE MT. PINATUBO COMMISSION TO THE CONCERNED LOCAL GOVERNMENT UNITS


WHEREAS, by operation of law, specifically Republic Act 7637 and Proclamation No. 1201, the Mt. Pinatubo Rehabilitation, Assistance and Development Commission, hereinafter referred to as the MPC, shall expire on 31 December 2000;


WHEREAS, Local Government Units (LGUs) in the areas affected by the eruption of Mt. Pinatubo and its after-math, are primarily concerned with the rehabilitation and development of their areas of responsibility;


WHEREAS, the transfer of the remaining resettlement functions and responsibilities of the MPC over upland resettlement sites to the concerned LGUs is in accord with the objectives of the decentralization program of the national government and is being pursued to strengthen the capability of the LGUs to implement development programs;


WHEREAS, the LGUs have expressed willingness to take on the administration and management of the upland resettlement sites;


NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order and direct as follows:


Section 1. The MPC shall effect the transfer of the administrative supervision, control, management and maintenance of the ten (10) resettlement sites classified as upland communities to the concerned LGUs having territorial jurisdiction over the area, with the exception of such components or utilities as may be transferred to the appropriate national government agencies or entities.


Section 2. An integral part of the transfer of the upland resettlement sites from the MPC to the LGUs shall be a resolution of the concerned Sangguniang Bayan/Panlalawigan/Panlungsod authorizing the local chief executive to accept the site for and in behalf of the municipality/city/province.


Section 3. In pursuance of the following mandate, the Chairman of the MPC and the concerned local chief executive, are authorized to prepare and enter into the corresponding Memorandum of Agreement covering the transfer of resettlement functions from MPC to the LGU.


Section 4. This order shall take effect immediately upon signing.
